The Compassionate Use Act of 1996 (CUA)
In 1996, California voters enacted Proposition 215, codified as Health & Safety Code 11362.5:
The people of the State of California hereby find and declare that the purposes of the CUA are as follows:
In 2003, the California state legislature passed SB 420, also known as the Medical Marijuana Program Act, in an attempt to clarify the Compassionate Use Act. Among other things, SB 420 established protection from arrest and prosecution for cultivation, use, possession and transportation for those who are in compliance with their local or state guidelines. SB 420 also authorizes the existence of medical marijuana collectives and cooperatives. This is an important expansion of legal rights for medical marijuana dispensing collectives and cooperatives serving large numbers of patients.

GUIDELINES FOR THE SECURITY AND NON-DIVERSION
OF MARIJUANA GROWN FOR MEDICAL USE

In 1996, California voters approved an initiative that exempted certain patients and their primary caregivers from criminal liability under state law for the possession and cultivation of
marijuana. In 2003, the Legislature enacted additional legislation relating to medical marijuana. One of those statutes requires the Attorney General to adopt “guidelines to ensure the security and nondiversion of marijuana grown for medical use.” (Health & Saf. Code, § 11362.81(d).1)
To fulfill this mandate, this Office is issuing the following guidelines to (1) ensure that marijuana
grown for medical purposes remains secure and does not find its way to non-patients or illicit markets, (2) help law enforcement agencies perform their duties effectively and in accordance with California law, and (3) help patients and primary caregivers understand how they may cultivate, transport, possess, and use medical marijuana under California law.
Courts have found an implied defense to the transportation of medical marijuana when the “quantity transported and the method, timing and distance of the transportation are reasonably related to the patient’s current medical needs.” (People v. Trippet (1997) 56 Cal.App.4th 1532, 1551.)
U.S. Attorney General, Eric Holder’s made the Federal Department of Justice public policy statement on medical marijuana in February 2009. A.G. Holder’s position is that states will now decide on the use and distribution of medical marijuana. The California Highway Patrol adopted a new policy on August 22, 2005, regarding medical marijuana. This new policy discourages CHP officers from confiscating medicine, and provides officers with instructions on how to verify valid medical marijuana documentation. A memo issued to all CHP Command Centers defines for CHP personnel what the new policy means, including this example scenario of a traffic stop:
An officer initiates an enforcement contact on a vehicle at 0200 hours for a mechanical violation and observers (sic) a small baggie of what appears to be marijuana sitting on the seat next to the driver. The driver claims 11352.7 (sic) H&S and presents a note from a physician recommending medical marijuana. The officer should contact the local communication/dispatch center to attempt to verify the validity of the claim. If the claim is valid, and the individual is within the state/local limit, no enforcement action should be initiated regarding the medical marijuana.

LIVINGSTON -- The City Council on Thursday will consider an emergency ordinance to place a 45-day moratorium on opening medical marijuana dispensaries in the city.
A city staff report prepared for the council explains that someone recently asked about the process needed to open a medical marijuana dispensary in Livingston. City Manager Richard Warne didn't know who that person was or whether he or she owns established dispensaries in California.

The public had a chance to weigh in on a possible moratorium on medical marijuana dispensaries Thursday night as the Yreka City Council held its regularly scheduled meeting with two related ordinances up for discussion.

A medical marijuana identification card program will come before the Stanislaus County Board of Supervisors sometime in the next few months. It's a program that has been in the works for more than 2½ years.
Stanislaus is one of just 12 of the state's 58 counties that does not already have an identification card program, which is required by state law. The programs issue identification cards to medical marijuana users who ask for them. The cards can then be shown to law enforcement officers when patients are stopped and questioned about possession of the drug.

The Tuolumne Narcotics Team destroyed about 6,400 marijuana plants from an area near Beardsley Reservoir, authorities reported. Officials got to the site Friday and found that the growers had harvested 75 percent of the plants Thursday night, Tuolumne County sheriff's spokesman Lt. Dan Bressler said. No arrests were made. Authorities estimated that each plant was worth $1,000 to $2,000. Bressler said officials have removed 70,000 marijuana plants this season.

Narcotics investigators found 14,929 marijuana plants worth about $29.8 million Thursday in two outdoor growing operations in southern Tuolumne County, according to sheriff's officials. Authorities later destroyed the seized marijuana. No arrests were made. The Tuolumne Narcotics Team discovered the growing operations assisted by officials from the state Department of Justice's Campaign Against Marijuana Planting and agents from the U.S. Bureau of Land Management, according to a Tuolumne County sheriff's news release. The marijuana gardens were found in the Moccasin Creek area near Highway 49. While investigators were flying above the gardens, they spotted a man fleeing the scene. Authorities did not find the man. The plants were mature and ready to be harvested, sheriff's officials said. They said the value of the marijuana was $2,000 per plant.

OAKDALE — The owner of a medical marijuana dispensary raided by police last summer has filed claims seeking about $2 million from the city of Oakdale and Stanislaus County.
Addison DeMoura, who owns Oakdale Natural Choice Collective Inc., was arrested after county drug enforcement agents and the Oakdale Police Department raided the dispensary and his home on July 31. He has not been charged.

Two Modesto City Council members criticized the Police Department Tuesday for providing inaccurate and "over the top" presentations on two proposed ordinances their colleagues supported.
Janice Keating and Will O'Bryant took issue with PowerPoint slides officers gave the council Jan. 8 describing reasons to pass separate measures banning Dumpster diving and increasing penalties for possessing alcohol in city parks.
Merced County Supervisors Ban Medicinal Marijuana Dispensaries

MERCED -- Merced County officials passed an ordinance this week permanently banning medical marijuana dispensaries across the unincorporated county.
The Board of Supervisors voted unanimously Tuesday to support the ordinance, which mirrors ordinances adopted by the cities of Modesto, Ceres, Merced, Patterson, Atwater and Los Banos. Many other cities have moratoriums on dispensaries.

MODESTO -- A gunman stole 3 pounds of marijuana from the garden of several medical marijuana users in a southwest Modesto home last week.
The growers valued the loss at $12,000 to $16,000. They had tended the buds from seeds for nine months in a greenhouse full of bell peppers, tomatoes, corn and sunflowers.
No one has been arrested.
The four men each had medical clearance to use marijuana, which allowed them to grow cannabis for personal use, the Modesto police reported.

Seven people arrested on drug charges stemming from an investigation into an Oakdale medical marijuana dispensary were in court Wednesday. Their arraignments were put off until Sept. 25 so the district attorney has more time to investigate.
